MARCHING AND THE LAW: PRACTICAL INFORMATION ABOUT YOUR RIGHTS

MARCHING AND THE LAW: PRACTICAL INFORMATION ABOUT YOUR RIGHTS

A pamphlet prepared by the Legal Committee Of the No One Is Illegal – March On Ottawa
Solidarity Across Borders

The following document has been prepared in order to give participants of the No One Is Illegal: March on Ottawa a general understanding of their rights and of the potential risks involved in participating in the march. If you have questions relating to your specific case we HIGHLY recommend that you speak with an experienced lawyer.
Note: This is a ROUGH GUIDE. We have only briefly canvassed infractions under the Criminal Code and some provisions of the Immigration and Refugee Protection Act. We have not looked at possible municipal infractions or infractions under the Highway Safety Code.

It is important that everyone who marches is informed of his or her rights and risks. This pamphlet is only giving general information; if you have specific questions speak to a lawyer. People who are not lawyers may give you inaccurate information.

THE MARCH BEGINS!!

The NO ONE IS ILLEGAL MARCH ON OTTAWA kicks off today!!

To all friends and allies of non-status migrants in Canada :

Please take the time to READ and ACT on this final organizing update about the week-long, 200km, NO ONE IS ILLEGAL MARCH ON OTTAWA that begins TODAY (Saturday, June 18)! We rely on your participation and support.

We are marching in solidarity with all non-status persons in Canada, and in support of the main demands of the Solidarity Across Borders network: the regularization of all non-status persons in Canada; an end to the deportation and detention of migrants; and the abolition of security certificates.

This update contains detailed information about our march, for people in the Montreal-area, and ALSO for people outside of Montreal who wish to get involved and support the march, in whatever way. Whether you march, or you support us from where you live, your solidarity is appreciated and needed! Read on …

The 12 principles for a regularization program

Solidarity Across Borders

Principles for a Regularization Program in Canada

The following principles were drafted at the STATUS Conference in Toronto (November 2004):

Principle 1: We need a comprehensive, transparent, inclusive and ongoing regularization program that is both equitable and accessible to ALL persons living without legal immigration status in Canada (non-status). Any such program must not be contingent upon a person's participation in the labour force, nor should it exclude particular groups such as the poor, unwaged, unemployed and those who have ever accessed any government assistance. Likewise, it should not be limited to any group, such as members of a trade or profession, selected sectors or industries, those determined to be successfully integrated, and so on.

Day 1 :
June 18 - We will be leaving from metro Atwater at noon, marching through downtown Montreal, along Ste-Catherine Street, and north on St-Denis and St-Laurent to Parc Extension; we'll go west along Jean-Talon into Cote-des-Neiges. The first evening, around 6pm, we'll be stopping at Kent Park, where a neighborhood party is planned, with food and music (confirmed acts include Nomadic Massive!). Marchers will be staying at a local school and community center for the night.
