She was arrested in a pre-planned public ambush involving border\u00a0authorities at Berri-UQAM metro station last week on January 22, 2014.\u00a0Ivonne was arrested while she was picking up her one-year old son from her\u00a0ex-partner and detained.<\/p>\n<p>Ivonne Hernandez was released from immigration detention on January 24 on a\u00a0$4000 cash bond. She is required to report to immigration authorities\u00a0regularly. The removal order against her is still in effect. No deportation\u00a0date has been set, but there is a risk of removal at any time. If she is\u00a0deported, her son will be separated from her, perhaps for life.<\/p>\n<p>Every aspect of this case is disgusting and shocking. Ivonne should never\u00a0have been detained. Ivonne should have permanent status in Canada. Ivonne\u00a0should have protection from conjugal violence. And, most importantly,\u00a0Ivonne, a loving mother, should not be separated from her son.<\/p>\n<p><strong>BACKGROUND<\/strong><\/p>\n<p>Ivonne Hernandez came to Canada to seek asylum in 2009 but was refused in\u00a02011 and ordered deported. Rather than return to the very real danger she\u00a0faced in Mexico, Ivonne joined the estimated half a million people living\u00a0without papers in Canada, among the most vulnerable and exploited members of\u00a0our society.<\/p>\n<p>On December 11, 2013, Ivonne fled to a women&#8217;s shelter with her son to\u00a0escape a situation of conjugal violence. Her ex-partner promptly denounced\u00a0her to authorities.<\/p>\n<p>In a shocking and rushed ruling on January 10, 2014, a family court judge\u00a0awarded custody of Ivonne&#8217;s one-year old child to the Canadian father solely\u00a0because of Ivonne&#8217;s vulnerable immigration status. Ivonne and her son are\u00a0allowed to see each other only eight hours a week.<\/p>\n<p>Canada has made it very difficult for people in Ivonne&#8217;s situation to\u00a0regularize their status. Although Mexico has one of the highest rates of\u00a0domestic violence in the world, and has an extremely high homicide rate,\u00a0Canada has placed Mexico on a list of &#8220;safe countries&#8221;, countries that\u00a0Canada claims can protect its citizens from violence. A request to re-open\u00a0Ivonne&#8217;s immigration file was made in November, because immigration\u00a0officials failed to take all of the evidence into account, but there has not\u00a0yet been a response. However, the Minister of Immigration has the\u00a0discretionary power &#8211; and the obligation under international law &#8211; to\u00a0intervene in the file and regularize Ivonne&#8217;s status.<\/p>\n<p><strong>WHAT YOU CAN DO<\/strong><\/p>\n<p><strong>i) Write Organizational Letters of Support<\/strong><\/p>\n<p>We encourage organizations to write public letters of support for Ivonne\u00a0that we can share publicly on our website. Letters written uniquely by\u00a0organizations (collectives, associations, unions, locals, shelters,\u00a0community centers, cooperatives, etc) have a greater impact than a generic\u00a0letter.
